Customer Conduct
NQ Ally Works Pty Ltd and any member of staff reserves the right at the discretion of management to refuse service and supply of products to customers who exhibit or direct the following behavior towards any member of staff:
- bullying
- harrasement
- aggressive & inappropriate behavior & language
- racism
- rude & disrespectful conduct
At no time shall any member of staff tolerate such behavior. NQ All Works Pty Ltd reserves the right to redirect any product that has been ordered and not yet delivered back to NQ Ally Works depot in which case a full refund of the purchase amount back to the customer will be conducted. NQ Ally Works Pty Ltd will not be liable for any incidental or consequential costs or damages resulting from product redirection.
All products are supplied & covered IAW the warranty terms & conditions outline in the specific product section on the webstore.
Intellectual Property (IP) Rights
The content and design of the Website, imagery and logos used to depict the products on our Website form part of our intellectual property. Products are also the subject of our intellectual property. NQ Ally Works Pty Ltd will defend the intellectual property rights in connection with our products and the Website.
Title and ownership of our intellectual property shall not be transferred by virtue of your use of the Website.
Unless specifically authorized by us, or otherwise allowed by applicable laws, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content ,designs, product designs, product concepts, ideas, improvements, inventions, innovations, processes, products, product specifications, methods of manufacture, developments, discoveries, samples, research, technical data, designs, formulas, devices, product features, specialized extruded aluminium systems, patterns, concepts, schematic models, diagrams, drawings and any and all enhancements relating to any of the foregoing on our Website, in whole or in part.
You may not use our name or logos, intellectual property or trademarks on any website or any other platform without our express written consent.
You agree to not offer products purchased from NQ Ally Works Pty Ltd t/as Kimberley2Cape 4wd & Adventure Accessories for resale without express written permission by NQ Ally Works Pty Ltd.
The customer warrants and acknowledges that by accessing, ordering and processing payment/s for any and all products listed for purchase on our website is acknowledgement and acceptance of the terms stated above. Default of these terms by the purchaser renders them liable for prosecution under Australian & Commonwealth Law where NQ Ally Works Pty Ltd may commence legal proceedings against any customer, person or company found or suspected to be found guilty. Should such proceedings take place NQ Ally Works Pty Lld shall seek full reimbursement of financial compensation deemed sufficient by the courts including all legal and court costs associated with the preparation for and conduct of all legal proceedings.
